TERMS & CONDITIONS OF SALE
1. PAYMENT
(a) Unless the sale is for cash or is upon the shorter credit terms indicated on your invoice, accounts are due for payment by the last day of the month following the date of invoice, payments received by us later than the last day of the month will be deemed as late payments. Any late payment may be subject to interest charges for each day late at base rate. If we receive no payment after sending a written reminder to the customer then legal action will proceed. Receipts will only be recognised if on our printed form.
(b) If the sale is to be paid via cash, cheque or credit/debit card, or Paypal, DoBuild Direct Ltd must receive cleared funds and payment in full before delivery/service can commence.
(c) We reserve the right to refuse to execute an order or contract if the arrangements for payment or the customer’s credit are not satisfactory to us. Interest at the rate of 2½% per annum above the current Barclays Bank plc base rate shall be payable in respect of all sums outstanding.
(d) For non-payment of invoice or account, legal fees and collection fees to reclaim the money will be charged; £100 court and admin fees, 5% of the total balance owed, and all other collection and bailiff charges will be passed on to our customer for payment.
2. DELIVERY
If the customer wishes to claim that there is any shortage on delivery in respect of goods or materials supplied by us or our supplier direct to the customer (or that the same have been damaged in transit or that any goods or materials are defective or not in accordance with the contract), he/she shall give notice to us within 24 hours of delivery of the same. If the customer fails to give such notice and fails to give us the opportunity to inspect the entire consignment, the goods or materials shall be deemed to have been delivered in good order and to be in accordance with the contract in all respects.
3. PRESENTATION
(a) The customer must be responsible for the suitability of the goods or materials he/she orders. No condition is made or to be implied nor is any warranty given or to be implied as to the suitability of the goods or materials for any particular purpose or for use and any specific condition notwithstanding that such purpose or conditions may be known or made known to us.
(b) In accepting delivery of the goods you acknowledge that no representations whether oral or in writing have been made by us or by any officer, servant or agent of ours which have induced you to enter into the contract for the purchase of the goods.
4. DEFECTIVE GOODS
Save as herein appearing goods or materials supplied will be replaced or repaired free of chard or in our absolute discretion the purchase price refunded in we are satisfied that they were defective in materials or workmanship on delivery and notice of the defect is given to us within 48 hours of delivery and the goods are returned to our suppliers depot carriage paid. No refund will be made without original invoice/receipt. Apart from our liability for damages for the personal injury or death of any person due to defective goods being supplied, our liability for loss arising from negligence or breach of contract shall be limited to the contract price of the goods.
5. CANCELLATION
Contracts and special orders may not be cancelled by customers, except with our written sanction only. Orders for goods made or cut specially to order cannot be cancelled or returned.
6. RISK
All goods sold are at the sole risk of the customer after their delivery or collection.
7. TITLE
(a) The property in goods or materials sold by us to the customer shall remain vested in us until all sums owed by the customer to us on whatsoever grounds shall have been paid.
(b) The customer shall store goods or materials sold by us in such a way that they are readily capable of being identified as our property.
(c) We shall have the right at any time to repossess goods or materials sold by us to which title shall not have passed. In this event we shall be absolutely entitled to resell the same or to use them in our business as we may think fit. If we resell the same goods or materials we shall be absolutely entitled to the proceeds of resale.
(d) The customer shall for that purpose give us access and we shall be entitled to enter any premises in the occupation of the customer or to which the customer has access and where the goods or materials may then be situated.
